1. Scope

These Terms govern the use of this website and all brokerage and vehicle sales services provided by
MASSIMO & JAQUELINE CARUSO LTD.

2. Business Model

The Company operates both:

a) as a vehicle broker (intermediary between buyers and third-party sellers), and
b) as a direct seller of vehicles owned by the Company.

The Company’s role will be specified in each individual transaction.

3. Brokerage Services

Where acting solely as intermediary:

The purchase contract is concluded directly between buyer and third-party seller.

The Company is not the contractual seller.

Vehicle information is based on third-party data.

No liability is assumed for inaccuracies in third-party information except in cases of intent or gross negligence.

4. Direct Sales (Company-Owned Vehicles)

Where the Company sells vehicles from its own inventory:

The purchase contract is concluded between buyer and the Company.

Vehicles may be new or used.

For used vehicles sold to consumers, statutory warranty rights apply.
To the extent permitted by law, the warranty period for used vehicles may be limited to one (1) year.

For business customers (B2B), warranty rights may be excluded to the extent permitted by law.

5. Prices & Availability

All listings are non-binding and subject to prior sale.

Prices and specifications may change without notice.

6. Payment & Transfer of Ownership

Ownership transfers only upon full payment of the agreed purchase price.

Payment terms are defined individually in the purchase agreement.

7. Limitation of Liability

The Company is fully liable for:

Intentional misconduct

Gross negligence

Injury to life, body, or health

For slight negligence, liability is limited to foreseeable damages arising from essential contractual obligations.

Indirect damages and loss of profit are excluded to the extent permitted by law.

8. Governing Law & Jurisdiction

These Terms are governed by the laws of the Republic of Cyprus.

The courts of the Republic of Cyprus shall have jurisdiction, unless mandatory consumer protection laws provide otherwise.

9. Severability

If any provision is found invalid, the remaining provisions remain unaffected.
